Nearly six years after reaching a landmark legal agreement, checks from a $2.67 billion settlement fund tied to Blue Cross Blue Shield (BCBS) health insurance are finally set to be distributed to eligible subscribers in 2026. The long-awaited payments represent one of the largest antitrust settlements in the history of the U.S. health insurance industry, affecting millions of policyholders across the country.

Background of the Antitrust Lawsuit

The legal case originated from a class action antitrust lawsuit filed in Alabama under the title Blue Cross Blue Shield Antitrust Litigation MDL 2406, N.D. Ala. Master File No. 2:13-cv-20000-RDP. The plaintiffs alleged that BCBS and its affiliated Blue Individual Plans violated federal antitrust laws by agreeing not to compete with one another and deliberately limiting competition in the sale of health insurance and health insurance administration services across the United States.

Blue Cross Blue Shield Association (BCBSA) and its affiliated plans denied all allegations of wrongdoing, maintaining that their business practices actually resulted in lower healthcare costs and broader access to care for customers. Rather than proceed to a full trial, both parties agreed to settle in order to avoid the ongoing financial and legal risks of prolonged litigation. The Settlement Agreement was formally signed on October 16, 2020, and received final judicial approval in August 2025.

Who Is Eligible for Payment?

The settlement covers a broad class of individuals and businesses. You may be eligible if you purchased or received health insurance provided or administered by a Blue Cross Blue Shield company at any point between February 2008 and October 2020. This includes both individual policyholders and employer-sponsored plan participants who were covered during that period.

However, eligibility for a payment requires that you submitted a valid claim before the November 5, 2021 deadline. If you missed that deadline, unfortunately you will not receive a monetary payment from the settlement fund, though you may still benefit from the operational changes BCBS has agreed to implement.

How the $2.67 Billion Will Be Distributed

The $2.67 billion settlement fund is divided into two primary components. Approximately $1.9 billion has been allocated to reimburse subscribers who filed eligible claims during the claims period. The remaining $700 million will be directed to attorneys’ fees and litigation costs associated with the case.

The settlement recognizes two distinct classes of beneficiaries. The Damages Class consists of subscribers seeking direct monetary compensation. The Injunctive Class includes individuals and entities that will benefit from the structural changes BCBS must implement as part of the agreement, even if they do not receive direct payments.

Key Changes to BCBS Operations

Beyond the financial compensation, the settlement also requires BCBS to make meaningful operational changes designed to increase competition within the health insurance marketplace. According to the plaintiffs, these changes will open the door to greater market competition, which could ultimately benefit consumers through improved pricing and more insurance options in the years ahead.

What Happens Next for Subscribers

Distribution of settlement checks is expected to begin in 2026. Eligible claimants who submitted their forms ahead of the November 2021 deadline can anticipate receiving payment notifications as the process moves forward. Subscribers are encouraged to ensure their mailing addresses and contact information are current with the settlement administrator to avoid delays in receiving their funds.
